Agreement to these terms
These Terms of Service govern your access to and use of GapTheory. By creating an account or using the product, you agree to these terms. If you do not agree, please do not use the service.
What GapTheory is
GapTheory is a market intelligence tool. It surfaces and scores unmet needs found in public and licensed data so you can make more informed decisions about what to build. GapTheory provides information and analysis, not guarantees. It does not promise that any opportunity will succeed or that any outcome will occur.
Beta software
GapTheory is currently offered as a beta. That means features may change, the service may occasionally be unavailable, and data may be incomplete or imperfect. We provide the beta as-is and appreciate your feedback in helping us improve it.
Accounts and eligibility
You must provide accurate information when you apply and register, keep your login credentials secure, and be at least 18 years old. You are responsible for activity that happens under your account. Access to the beta is granted at our discretion and may be limited to invited users.
Acceptable use
When using GapTheory, you agree not to:
- Resell, redistribute, or scrape the data or content in bulk without our written permission.
- Attempt to gain unauthorized access to the service, other accounts, or our systems.
- Use the service to violate any law or the rights of others.
- Interfere with or disrupt the integrity or performance of the service.
Intellectual property
The GapTheory product, including its analysis, scores, groupings, and presentation, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the product for your own business purposes during your access period.
The ideas and inputs you provide remain yours. You grant us permission to process them as needed to provide the service, as described in our Privacy Policy.
Not professional advice
GapTheory does not provide investment, legal, financial, or business advice. The information it surfaces is intended to support your own judgment, not replace it. Decisions you make based on the product are your own responsibility.
Payments
The beta is currently free. If you purchase a paid plan in the future, the applicable price and billing terms will be shown at checkout, and payments will be handled by our payment processor. Unless stated otherwise or required by law, payments are non-refundable.
Disclaimers
The service is provided on an as-is and as-available basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that the data will be complete or accurate.
Limitation of liability
To the fullest extent permitted by law, GapTheory and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising from your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim, or one hundred dollars if you have not paid us anything.
Termination
You may stop using the service and close your account at any time. We may suspend or terminate access if you violate these terms or if we need to protect the service or other users. Provisions that by their nature should survive termination will continue to apply.
Changes to these terms
We may update these terms as the product evolves. When we make material changes, we will update the date at the top of this page. Your continued use of the service after changes take effect means you accept the updated terms.
